Authorities

How consumers complain (our summary): Art. 25(2): any natural or legal person may report a non-compliant service to OSAPS. The law does not require contacting the provider first. OSAPS's 'Signaler un problème' page (https://accessibilite-produits-services.public.lu/fr/communaute/signaler.html) lists these channels: Guichet.lu form, the OSAPS web form, phone 24 77 65 55, WhatsApp 621 840 598, e-mail, and post to OSAPS, 11, rue Robert Stumper, L-2557 Luxembourg. The page shows two e-mail addresses (signal@osaps.etat.lu in the text, signalement@osaps.etat.lu in the link). If the operator fails to fix the problem, OSAPS may restrict or prohibit the service (Art. 25(3)).

Where service providers must publish accessibility information

Art. 15(2): service providers prepare the information required by Annex II of the law and explain how the services meet the accessibility requirements. The information is made public in written and oral form, including in a way accessible to persons with disabilities, and kept while the service is available. Annex II(1): the information goes in the general terms and conditions or an equivalent document. On top of consumer-information duties under the Consumer Code, it includes: 1° a general description of the service in accessible formats; 2° the descriptions and explanations needed to understand how the service works; 3° a description of how the service meets the Annex I requirements of Directive (EU) 2019/882. Annex II(2): harmonised standards may be applied. Annex II(3): information showing that the service process and its monitoring ensure compliance. The law sets no language for this information. (our summary)

Microenterprise exemption

Art. 6(4): microenterprises providing services are exempt from the Art. 6(3) accessibility requirements and all related compliance obligations. Art. 2, 14°, defines a microenterprise as having fewer than 10 employees and annual turnover or annual balance-sheet total not exceeding EUR 2,000,000. (our summary)

Under the Directive, microenterprises providing services are exempt (Article 4(5)); a microenterprise employs fewer than 10 persons and has an annual turnover or balance sheet total not exceeding €2 million (Article 3(23)).
