Authorities

How consumers complain (our summary): Complaints/denuncias to the regional surveillance authority, or via the UTAC (DG Rights of Persons with Disabilities), which must provide means to receive denuncias and reclamaciones (art. 3(g) RD 143/2026); art. 29 Ley 11/2023 also preserves the disability-equality arbitration procedure and consumer procedures, and access to administrative bodies and courts. The UTAC web page states an electronic complaints procedure will be enabled on the Ministry's e-office and meanwhile refers to the Ministry's 'Infracciones y sanciones' page.

Where service providers must publish accessibility information

Art. 13(2): service providers include, 'en las condiciones generales o documento equivalente', information assessing how the service meets the requirements of art. 3, including at least (a) a general description of the service in universally accessible formats, (b) descriptions/explanations needed to understand its operation in accessible formats, (c) description of how service provision and monitoring ensure conformity. Art. 13(4): available to the public in written and oral format and accessible to persons with disabilities; kept and updated while the service operates. (No specific language rule for service information found; art. 18 requires the products' EU declaration at least in Castilian and the official language of the territory.) (our summary)

Microenterprise exemption

Art. 3(3): 'Las microempresas que presten servicios estarán exentas de cumplir los requisitos de accesibilidad a que se refiere el párrafo tercero del apartado 1 y cualquier obligación relativa al cumplimiento de dichos requisitos.' Definition: Annex/definitions point 16 (fewer than 10 persons, turnover or balance sheet not over EUR 2 million). Additional provision 2: guidance for microenterprises. (our summary)

Under the Directive, microenterprises providing services are exempt (Article 4(5)); a microenterprise employs fewer than 10 persons and has an annual turnover or balance sheet total not exceeding €2 million (Article 3(23)).
